Derek Simms founded the law firm of Simms and Associates in 1999 to defend the rights of the criminally accused.  He quickly gained notoriety by obtaining acquittals and dismissals in criminal courts across the state. He has successfully handled numerous appeals before the Alabama Court of Criminal Appeals, as well as the Alabama Supreme Court. He is a member of the National Association of Criminal Defense Lawyers, the National College of DUI Defense, and has been recognized by Birmingham Metro Magazine as one of the top attorneys in Birmingham since 2016.

Erik D. Fine

Erik D. Fine, Senior Associate Attorney at Simms & Associates, is a graduate of Kansas City Kansas Community College where he received an Associate of Arts degree in Law Enforcement in 1989 while on  scholarship.  He received a Bachelor of Science degree from the University of Alabama at Birmingham in Criminal Justice in 1991.  He was admitted to the Birmingham School of Law in 2008 where he became a member of the prestigious Sigma Delta Kappa Academic Honor Fraternity.
Law Enforcement Insight
Mr. Fine has served both as a police officer and a corrections officer for a total of 19 years.  As part of his law enforcement training, he was certified as a traffic accident re-constructionist by the Institute of Police Technology and Management and is experienced in car, motorcycle, commercial vehicle and train crashes. As a police officer, he made over 100 DUI arrests, and is well-versed in DUI detection, investigation and field sobriety testing.
Military Experience
Mr. Fine served honorably in the United States Navy as a hospital corpsman aboard the aircraft carrier, USS Enterprise (CVN-65).  He is also a certified paramedic, having successfully passed his National Registry Exam in 2007.
